Terms And Conditions

If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or not in accordance with this Terms of Use, We shall have the right to indefinitely suspend or terminate or block Your access on the Platform.

If there is reason to believe that there is likely to be a breach of security or misuse of Your account, We may request You to change the password or we may suspend Your account without any liability to Avelion Infotech, for such period of time as we deem appropriate in the circumstances. We shall not be liable for any loss or damage arising from Your failure to comply with this provision.

In the event of a device being associated with multiple logins or sign-ups, as a measure to enhance customer's security and privacy as well as safeguarding your sensitive information for any potential risks, Avelion Infotech sometimes considers moderating users and their association with devices while using the Avelion Infotech app or website.

Your mobile phone number is treated as Your primary identifier on the Platform. It is your responsibility to ensure that Your mobile phone number and your email address is up to date on the Platform at all times. You agree to notify Us promptly if your mobile phone number or e-mail address changes by updating the same on the Platform through an OTP verification. You agree that Avelion Infotech shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under your Account in cases, including, where You have failed to update Your revised mobile phone number and/or e-mail address on the Platform. You agree to immediately notify Avelion Infotech of any unauthorized use/breach of your password or account.

If You share or allow others to have access to Your account on the Platform ("Account"), by creating separate profiles under Your Account, or otherwise, they will be able to view and access Your Account information; You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences therefrom.

If You have not accessed Platform for a period of 2 (two) Years, Your data (including transactional data) will be deleted from Our records and You will not be able to access such data.

Avelion Infotech provides a number of Internet-based services through the Platform. One such Service enables Users to purchase original merchandise and tech accessories/products from various brands (collectively, "Products"). The Products can be purchased through the Platform through various methods of payment offered. The sale/purchase of Products shall be additionally governed by specific policies of sale, like cancellation policy, exchange policy, return policy, etc. (which are found on the FAQ tab on the Platform and all of which are incorporated here by reference). It is clarified that at the time of creating a return request, users are required to confirm (via a check box click) that the product being returned is unused and has the original tags/packaging intact. If the product returned by the user is used, damaged or if the original tags/packaging are missing, the user's return request shall be declined, and the said product shall be re-shipped back to the customer. In the event that the return request is declined, the user shall not be eligible for a refund and Avelion Infotech assumes no liability in this regard. Further, in the event that the user fails to accept the receipt of the said re-shipped product, the user shall continue to be not eligible for a refund, and Avelion Infotech assumes no liability with respect to the return or refund for the said re-shipped product. In addition, these Terms of Use may be further supplemented by Product-specific conditions, which may be displayed with that Product.

Avelion Infotech does not warrant that Product description or other content on the Platform is accurate, complete, reliable, current, or error-free and assumes no liability in this regard.

The Users utilize the Platform to meet and interact with one another for their transactions. Avelion Infotech is not and cannot be a party to or control in any manner any transaction between the Platform's Users.

Henceforward:

All commercial/contractual terms are offered by and agreed to between Buyers and Sellers alone. The commercial/contractual terms include without limitation price, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services and after-sales services related to products and services. Avelion Infotech does not have any control over or determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers and Sellers.

Placement of an order by a Buyer with a Seller on the Platform is an offer to buy the product(s) by the Buyer to the Seller and it shall not be construed as Seller's acceptance of Buyer's offer. The Seller retains the right to cancel any such order placed by the Buyer, at its sole discretion, and the Buyer shall be intimated of the same by way of an email/SMS. Any transaction price paid by Buyer in case of such cancellation by Seller shall be refunded to the Buyer. Further, the Seller may cancel an order wherein the quantities exceed typical individual consumption. What comprises a typical individual's consumption quantity limit shall be based on various factors at the sole discretion of the Seller.

Pricing on any product(s) as reflected on the Platform may, due to technical issues or typographical errors, be incorrectly reflected, and in such an event, the seller may cancel your order(s).

Avelion Infotech does not make any representation or warranty as to specifics (such as quality, value, salability, etc.) of the products or services offered to be sold or purchased on the Platform.

Avelion Infotech is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers. Avelion Infotech cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Platform.

At no time shall Avelion Infotech hold any right, title, or interest over the products, nor shall Avelion Infotech have any obligations or liabilities in respect of such contracts entered into between Buyers and Sellers.

Avelion Infotech is only a platform that can be utilized by Users to reach a larger base to buy and sell products or services. Avelion Infotech is only providing a platform for communication and it is agreed that the contract for sale of any products or services shall be a strictly bipartite contract between the Seller and the Buyer.

Avelion Infotech is not responsible for unsatisfactory or delayed performance of services or damages or delays as a result of products which are out of stock, unavailable, or backordered.

Select products offered by sellers may be eligible for business purchases on the Platform. Upon Your purchase of product(s) eligible for business purchases, You may be able to avail the benefits of GST input tax credit. Accordingly, at your request, an invoice containing the GSTIN as provided by You ("Tax Invoice") shall be issued to You by the Seller(s) selling such products. GST invoice will have, inter alia, the following details printed on it:

1. GSTIN associated with your registered business, as provided by you
2. Entity name of your registered business, as provided by you

Not all products are eligible for business purchases on the Platform and the same is solely at the discretion of the Sellers. You will be able to view the eligibility of Tax Invoice on the product page on the Platform.

For seamless availment of input tax credit, kindly mention the delivery address as the address which is mentioned as the registered place of business as per the records of GST authority. Please note that availment of input tax credit is subject to provisions of GST Act and rules.

The delivery and billing addresses will be required to be the same; please note that input tax credit will be denied by GST authorities if the delivery address and GSTIN in the GST invoice are from different states.

If GSTIN and/or business entity details are not provided by You, it will be presumed that it is a personal purchase and not a business purchase.

Avelion Infotech is not responsible to verify the correctness of the GSTIN and/or entity name provided by You, and You shall be entirely responsible to provide accurate details.

Avelion Infotech and Seller shall not entertain any request for any revision in the GST Invoice. Avelion Infotech and Seller shall not be liable for Your default including for reasons associated with details provided by You.

Avelion Infotech will not be liable in case You are not able to avail input tax credit or if input tax credit is denied to You for any reason whatsoever.

You release and indemnify Avelion Infotech and/or any of its officers and representatives from any cost, damage, liability, or other consequence of any of the actions of the Users of Avelion Infotech and specifically waive any claims that you may have in this behalf under any applicable law.

You agree, undertake, and confirm that Your use of the Platform shall be strictly governed by the following binding principles:

You shall not host, display, upload, modify, publish, transmit, update or share any information which:

1. Belongs to another person and to which You do not have any right to.
2. Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever.
3. Is misleading in any way.
4. Involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming".
5. Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous.
6. Infringes upon or violates any third party's rights including, but not limited to, intellectual property rights, rights of privacy or rights of publicity.
7. Contains restricted or password-only access pages, or hidden pages or images.
8. Provides instructional information about illegal activities.
9. Contains video, photographs, or images of another person (with a minor or an adult).
10. Tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or profiles.
11. Interferes with another USER's use and enjoyment of the Platform.
12. Infringes any patent, trademark, copyright or other proprietary rights.
13. Violates any law for the time being in force.
14. Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order.
15. Shall not be false, inaccurate or misleading.
16. Shall not create liability for Us or cause Us to lose the services of Our ISPs or other suppliers.

A User may be considered fraudulent or a loss to business due to fraudulent activity if any of the following scenarios are met:

1. User doesn't reply to the payment verification mail sent by Avelion Infotech.
2. User fails to produce adequate documents during payment details verification.
3. Misuse of another User's phone/email.
4. User uses invalid address, email, and phone number.
5. Overuse of a voucher code.
6. Use of a special voucher not tagged to the email ID used.
7. User returns the wrong product.
8. User refuses to pay for an order.
9. User is involved in snatch-and-run of any order.
10. Miscellaneous activities conducted with the sole intention to cause loss to business/revenue to Avelion Infotech.
11. User with excessive returns.
12. Repeated requests for monetary compensation for fake/used orders.

Avelion Infotech may cancel any order that classifies as 'Bulk Orders'/'Fraud orders' under certain criteria at any stage of product delivery.

You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device to access, acquire, copy or monitor any portion of the Platform.

You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder, as well as all applicable domestic and international laws.

AI Assistants/Tools deployed on the Platform (if any) are powered by AI Tools. They may respond with inaccurate or insensitive information; exercise discretion and avoid sharing personal information.

Avelion Infotech hereby disclaims any guarantees of exactness as to the finish, appearance, size, color, etc., of the final Product as ordered by the User. Avelion Infotech Return & Exchange Policy offers you the option to return or exchange items within the specified period.

Please note that you can only use Avelion Infotech Credits to buy products from your registered account on the Avelion Infotech app or website. Credits cannot be transferred to other users, bank accounts, or wallets.

Avelion Infotech may unilaterally terminate Your account upon any breach of these Terms. Any credits or promotional rewards earned will be forfeited in such cases.

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, and artwork (collectively, "Content") is third-party user-generated content and Avelion Infotech has no control over such content, acting merely as an intermediary. Such Content will become Our property, and You grant Us worldwide, perpetual, and transferable rights in such Content.

The Platform may utilize artificial intelligence, machine learning, and synthetic media generation tools. All AI-driven outputs are provided on an "as-is" and "as-available" basis. Avelion Infotech does not warrant the absolute accuracy of AI-generated content and shall not be held liable for any errors or omissions produced by these systems.

In the event of return/cancellation of any products in an order placed with an offer thereby falling below the minimum required threshold, the user shall be deemed ineligible for the offer. Any cashback already credited would be void and deducted from the refund balance.

All materials, products and services included on or otherwise made available to You through the Platform are provided on an "as is" and "as available" basis without any representation or warranties, express or implied.

Without prejudice to the foregoing, Avelion Infotech does not warrant that the Platform will be constantly available, or available at all, or that the information on the Platform is complete, true, accurate, or non-misleading.

By registering Your phone number with us, You consent to be contacted via phone calls and/or SMS notifications regarding order, shipment, or delivery updates. We will not use your personal information to initiate unauthorized promotional phone calls or SMS.

As a registered seller, you are allowed to list item(s) for sale on the Platform in accordance with incorporated Policies. You must be legally able to sell the item(s) you list and ensure they do not infringe upon third-party intellectual property or proprietary rights.

All listed items must be kept in stock for successful fulfilment. The description of the item must not be misleading and must describe its actual condition. Avelion Infotech reserves the right to delete duplicate listings across multiple categories.

While availing any of the payment method/s available on the Platform, We will not be responsible or assume any liability whatsoever in respect of any loss or damage arising directly or indirectly to You due to:

1. Lack of authorization for any transaction/s, or
2. Exceeding the preset limit mutually agreed by You and 'Bank/s', or
3. Any payment issues arising out of the transaction, or
4. Decline of transaction for any other reason/s.

All payments made against purchases/services on the Platform by you shall be compulsorily in Indian Rupees acceptable in the Republic of India.

Before shipping/delivering your order, the Seller or Platform may request supporting documents (Govt. issued ID and address proof) to establish ownership of the payment instrument used.

Further:

Transactions, Transaction Price, and commercial terms are bipartite contractual obligations between Buyer and Seller. Payment facility is merely provided to facilitate completion.

You authorize Avelion Infotech or its service providers to collect, process, and remit payments electronically or through Cash on Delivery.

You understand that the payment facility provided by Avelion Infotech is neither a banking nor financial service, but an automated online payment facilitator.

Payment Facility for Buyers — When you, as a Buyer, initiate a transaction on our platform, you enter into a legally binding and enforceable contract with the Seller to purchase products and/or services. You agree to pay the Transaction Price through your Issuing Bank to the Seller using our designated Payment Facility.

1. Delivery Timeline Extensions: You may agree with the Seller through electronic communication or automated platform features to extend or increase Dispatch or Delivery times. Any such extension, variation, or novation must comply with the Payment Facility Rules and Policies.
2. Delivery Notifications: You must electronically notify us through platform features immediately upon delivery or non-delivery within the timeframe specified in our Policies. Failure to notify within the specified period will be construed as deemed delivery. (For Cash on Delivery (COD) transactions, formal confirmation of receipt is not required.)
3. Refund Claims: You are entitled to claim a refund of the Transaction Price as your sole and exclusive remedy if delivery is not made within the agreed timeframe or policy period (whichever is earlier). Failure to raise a refund claim through platform features within the stipulated time makes you ineligible for a refund.
4. Product Category Exclusions: The Payment Facility may not be fully available for certain categories of products/services as outlined in our Policies; transactions in those categories may not be eligible for refunds.
5. Refund Payment Methods:

1. Prepaid Transactions: Refunds are made to the original payment source (Issuing Bank, UPI, or Bank Account) or, if chosen by you, issued as Platform Credits on behalf of the Seller.
2. COD Transactions: Refunds will be processed via electronic funds transfer (NEFT, RTGS, or RBI-approved online banking systems).
3. Currency and Limits: All refunds are processed in Indian Rupees (INR) and are equivalent to the received Transaction Price.
4. Bank Coverage: If your bank is not supported for automated refund processing, you will be required to provide alternate bank account details.

6. Fraud and Conditional Refunds: Refunds are conditional and subject to recourse by Avelion Infotech Private Limited in cases of misuse or policy violations. Verification documents may be requested before processing.
7. Transaction Limits and Verification: Avelion Infotech Private Limited reserves the right to impose transaction limits per individual, card, bank account, or timeframe, and may refuse to process transactions exceeding these limits or involving accounts with a history of questionable charges or legal/policy breaches.
8. Security and Suspicious Transactions: We reserve the right to perform security checks, hold payment confirmations, delay seller dispatch notices, or report/remit funds to law enforcement in cases of suspected fraud or illegal activity.
9. Limitation of Payment Liability: Neither Avelion Infotech Private Limited nor the Seller shall be liable for damages, interest, or claims resulting from unprocessed or delayed transactions caused by factors beyond our reasonable control (including incorrect bank details supplied by the Buyer).

1. PAN Card Requirement: As required by applicable law, if a customer makes a single purchase equal to or exceeding INR 2,00,000.00, they must upload a scanned copy of their PAN card on the platform within 4 days of purchase. Failure to submit a valid PAN card or a name discrepancy between the PAN card and the account will result in mandatory cancellation of the order. Submission is required only once per verified user profile.
2. Statutory Compliance: Buyers and Sellers must comply with all applicable local and national laws, including but not limited to:

1. Foreign Exchange Management Act (FEMA), 1999
2. Customs Act
3. Information Technology Act, 2000 (and amendments)
4. Prevention of Money Laundering Act, 2002
5. Income Tax Act, 1961 / applicable tax codes
6. Export-Import (EXIM) Policies of the Government of India

All payment instruments (Credit Cards, Debit Cards, Net Banking, UPI, Wallets) are processed through secure payment gateway infrastructures. These transactions are strictly governed by the underlying terms and conditions established between the Buyer and their respective Issuing Bank or payment processor.

You acknowledge that Avelion Infotech Private Limited operates an online e-commerce/facilitation platform connecting Buyers and Sellers. Avelion Infotech Private Limited acts as a facilitator and is not directly a party to, nor controls, the independent commercial terms set between independent Buyers and Sellers except as explicitly stated herein.

You agree to indemnify, defend, and hold harmless Avelion Infotech Private Limited, its owners, licensees, affiliates, group entities, officers, directors, agents, and employees from any third-party claims, demands, liabilities, penalties, or legal expenses (including reasonable attorneys' fees) arising out of your breach of these Terms of Use, Privacy Policy, applicable laws, or third-party intellectual property rights.

1. Platform Material: All materials, software, visual graphics, icons, text and media on the platform are protected by intellectual property laws and remain the property of Avelion Infotech Private Limited or its content suppliers. Material is provided solely for personal, non-commercial use.
2. User-Generated Content: You retain ownership of any content, media, or feedback you upload to the platform. However, by uploading content, you grant Avelion Infotech Private Limited a royalty-free, irrevocable, perpetual, worldwide, non-exclusive license to use, reproduce, modify, and display such content for reasonable operational and promotional business purposes.

To the maximum extent permitted by applicable law:

1. Avelion Infotech Private Limited shall not be liable for any indirect, punitive, incidental, special, or consequential damages resulting from the use or inability to use the platform services or products.
2. We are not responsible for product defect representations, express/implied manufacturer warranties, or non-availability of the platform due to maintenance or force majeure.
3. In any event, the total aggregate liability of Avelion Infotech Private Limited shall be strictly limited to an amount equal to the purchase value of the specific product/service ordered by you.

Avelion Infotech Private Limited reserves the right to suspend, disable, or terminate your access/account immediately, without prior notice, if:

1. You breach any provision of these Terms or company policies.
2. You engage in fraudulent, abusive, or unethical behavior (e.g., creating fake accounts, sharing misleading information, high abuse return rates, or malafide transactions).

Upon termination, any accrued promotional credits or loyalty rewards may be forfeited, and your right to access platform features will cease immediately.

1. Delivery Claims Notice: Any claims regarding order non-receipt, wrong delivery, or proof-of-delivery (POD) discrepancies must be submitted within 5 days of the marked delivery date on the platform portal. Unreported claims after 5 days will be deemed successfully delivered in good condition.
2. Open Box Delivery (Select Pincodes): Where available, delivery partners will open outer and brand packaging in your presence prior to final handover. If the item is missing or physically damaged, you must refuse delivery immediately. For COD orders, payment must be collected prior to opening; instant on-spot refunds are issued by the agent if rejected at handover. For prepaid orders, refunds route back to the source account.

1. Platform and Service Fees: Avelion Infotech Private Limited may charge nominal low-value order fees or platform maintenance fees, displayed transparently at checkout.
2. Transportation and Ownership Transfer: By placing an order, you authorize Avelion Infotech Private Limited to facilitate a third-party Logistics Transporter on your behalf. Title and ownership of the goods transfer directly from the Seller to you as soon as the item is handed to the Transporter.

These Terms shall be governed by and construed in accordance with the laws of India. Any legal action or dispute arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts and tribunals at Mumbai.
